If they utilized their own insured's coverage, then the claim gets filed under the person that struck you.In July, 2023, I sent a copy of the small claim I was being forced to file due to the negligence of 8+ months of phone calls, emails and failure on the part of USAA to close out this claim.They were served on August 28, 2023, and had 14 days, Until September 11, 2023 to respond.They filed an answer in court, but failed to serve me their answer, and they figured that out 2 days after they defaulted and served me via electronic mail, when they owed me a paper response as the case was not set up electronically.This is my empty mailbox on both September 13, and September 14, when they should have sent it overnight mail since they were filing 3 days before the deadline on a weekend.Jennifer Barros had to unpublish her profile after I showed her on Linkedn Because they do not own their own fraud and ripping off the injured.Attorney Antoniette Delgado only had 1 review on 2009 on her profile Lawyers cannot engage in underpayment of claims as attorneys, but Antoinette does. She wants the rules to work only one way, and she victim shames in her pleadings. Why they defaulted I'll never know.Small claims don't require 2 attorneys on them, they are meant to be paid under their insured's policy limits, but USAA is embezzling the would be settlement funds one victim at a time and both of these parties are party to insurance fraud.Case # 21S2300759 has been defaulted on by these two bad lawyers engaging in insurance fraud.USAA has more than 7 pages of cases in court just this year alone
